At Finagraph, our most important asset is our relationship with our user community. We are committed to maintaining the confidentiality, integrity and security of information about our users and their organizations. This Finagraph Privacy Policy describes how we treat personal information that is collected when you use our websites, mobile applications or other products and services (collectively the “Services”).

For purposes of this Privacy Policy, “Finagraph”, “we”, “us” and “our” means Booyami, Inc. dba as Finagraph and our affiliates.  This Privacy Policy shall apply to any Finagraph mobile application and other forms of Finagraph online activity that reference this Privacy Policy.  In such instances the term “Site” shall include the applicable mobile application or other Finagraph online activity wherever that term is used herein.

This Privacy Policy is incorporated into, and considered a part of, the CashFlowTool.com Terms of Use, currently located at https://www.cashflowtool.com/terms, the Strongbox Terms of Use located at www.finagraph.com/strongbox-tou and the Finagraph TaxReader Terms of Use currently located at https://www.finagraph.com/terms.  Any terms not defined herein have the meanings ascribed to them in the Terms of Use.

USER CONSENT

By submitting or making available Personal Data (as defined below) through the Services, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Data in accordance with this Privacy Policy. Your Personal Data may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country.

TYPES OF PERSONAL DATA WE COLLECT

Finagraph collects Personal Data and Anonymous Data from you when you visit our Site, when you send us information or communications in connection with your use of the Service, and/or when you download and use the Services. "Personal Data" means data that allows someone to identify or contact you, including, for example, your name, address, geographic location of your computer or mobile device, telephone number, credit card number and email addresses, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. "Anonymous Data" means data about you that is not associated with or linked to your Personal Data; Anonymous Data does not permit the identification of individual persons. We collect Personal Data and Anonymous Data, as described below.

Use of Finagraph’s websites

As is true of most other websites, Finagraph’s websites collect certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of Finagraph’s website, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our website, analyze trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences.

Finagraph has a legitimate interest in understanding how members, customers and potential customers use its website. This assists Finagraph with providing more relevant products and services, with communicating value to our sponsors and corporate members, and with providing appropriate staffing to meet member and customer needs.

Cookies and tracking technologies

Finagraph makes available a comprehensive Cookie Policy that describes the cookies and tracking technologies used on Finagraph’s websites and provides information on how users can accept or reject them. To view Finagraph’s Cookie Policy, please see Annex 1 below.

Personal Data you provide to us

We request Personal Data from you, such as first and last name, email and mailing addresses, telephone number, professional title, company name, and password, when you register for the Service. In addition, we (or our third-party credit card or payment processor on our behalf) will collect Personal Data including your credit card number or account information when you upgrade to a paid account. We also retain information on your behalf, such as the Personal Data described above and any correspondence. We may collect Personal Data voluntarily provided by you, including in emails to the Site, online forms, order and registration forms, surveys, promotion participation, phone calls with our customer service and through other means.  If you provide us feedback or contact us via email, we will collect your name and email address, IP address, as well as any other content included in the email, in order to send you a reply, and any information that you submit to us, such as a resume. We may receive Personal Data from social media platforms.  For example, if you elect to use your social media credentials to log-in to your Site account, certain Personal Data from your social media account will be shared with us, which may include Personal Data that is part of your profile.  We collect information through various other means, including participation at conferences and events and individual introductions. We may also collect Personal Data at other instances in the Site user experience where we state that Personal Data is being collected.

Personal Data Collected by Third Parties

We may receive Personal Data about you from other sources like telephone or fax, from companies that distribute the Service by way of a co-branded or private-labeled website, companies that offer their products and/or services via the Service, or companies that provide services (such as payment processing services) in connection with the Service (collectively, "Partner Companies"). Our Partner Companies may supply us with Personal Data, such as your name and email and mailing address information or your login credentials for such Partner Company’s website or service, in order to help us establish the account or fulfill orders. We may add this information to the information we have already collected from you via our website in order to perform and improve the Service.

This Privacy Policy applies only to the use and disclosure of Personal Data that we collect while you use the Service. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. When you click on such a link, you will leave our Site and go to another site. During this process, a third party may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on a link to a third party.

Personal Data Collected via Technology

The Service (which may be hosted by a third-party service provider) collects Personal Data from you, such as browser type, geographic location of your mobile device or computer, operating system and version, Internet Protocol (IP) address, domain name, information about your application, operating environment and hardware profiles and/or a date/time stamp for your visit. We may also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and/or access to the Service and your activity on the Site. Like most Internet services, we automatically gather this Personal Data and store it in log files each time you visit the Site or access your account on our network.

USE OF YOUR PERSONAL DATA

Finagraph uses your Personal Data in the following ways:

  • to facilitate the creation of and secure your account on our network; identify you as a user in our system;

  • to provide improved administration of the Service;

  • to improve the quality of experience when you interact with the Service;

  • to send you a welcome email to verify ownership of the email address provided when your account was created;

  • to send you administrative email notifications, such as security or support and maintenance advisories;

  • to respond to your inquiries related to employment opportunities or other requests;

  • to send promotional communications;

  • to provide you with hardcopy or electronic newsletters, or surveys;

  • to send upgrades and special offers related to the Service and for other marketing purposes of Finagraph or our Partner Companies; and

  • to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback.

We may create Anonymous Data records from Personal Data by excluding information (such as your name and email) that render the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content and functionality of the Service. Finagraph reserves the right to use for other purposes and to disclose Anonymous Data to third parties in its discretion.

If you provide feedback on the Service, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Data. Finagraph will collect and store any information contained in such communication and will treat the Personal Data in such communication in accordance with this Privacy Policy.

DISCLOSURE OF YOUR PERSONAL DATA

We may share your Personal Data with Partner Companies to provide technical support or to provide specific services, such as hosting of your applications, maintenance services, database management or payment processing for purchases. Partner Companies will have access to your Personal Data only to perform these services on our behalf and are obligated not to disclose or use it for any other purpose.  A list of our third-party sub processors can be found in Annex 2 below.

We may share some or all of your Personal Data with a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "Related Entities"), in which case we will require our Related Entities to honor this Privacy Policy.

Finagraph may sell/divest/transfer the company (including any shares in the company), or any combination of its products, services, assets and/or businesses. Personal Data may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of the company.

Regardless of any choices you make regarding your Personal Data (if applicable), Finagraph may disclose Personal Data if it believes in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on Finagraph; or (b) protect or defend the rights or property of Finagraph or users of the Service.

Except as otherwise stated in this policy, we do not generally sell, trade, share, or rent the Personal Data collected from our services to third parties. You expressly consent to the sharing of your Personal Data as described in this policy.

PERSONAL DATA CHANGES

You may change any of your Personal Data in your account by editing your profile within the registration portion of the Site or by sending an email to us at the email address set forth below. You may request deletion of your account information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).

PROMOTIONAL COMMUNICATIONS

You may opt out of receiving promotional communications from us by following the instructions in those messages.  If you opt out, we may still send you non-promotional communications, such as those about your account, previous purchases or our ongoing business relations.

MINORS

We do not intentionally gather Personal Data about visitors who are under the age of 18, and we request that these individuals do not provide Personal Data through the Site.

CALIFORNIA PRIVACY RIGHTS

Users who are California residents may request and obtain from us once a year, free of charge, certain information about the Personal Data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Data that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. SECURITY OF YOUR APPLICATION AND PERSONAL DATA

Finagraph is committed to protecting the security of your Personal Data. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people. Despite these measures, you should know that Finagraph cannot fully eliminate security risks associated with Personal Data.

STORAGE AND PROCESSING

Finagraph has its headquarters in the United States. Information we collect about you will be processed in the United States. By using Finagraph’s Services, you acknowledge that your personal information will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. Pursuant to Article 46 of the GDPR, Finagraph is providing for appropriate safeguards by entering binding, standard data protection clauses, enforceable by data subjects in the EEA and the UK. These clauses have been enhanced based on the guidance of the European Data Protection Board and will be updated when the new draft model clauses are approved.

Depending on the circumstance, Finagraph also collects and transfers to the U.S. personal data with consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Finagraph in a manner that does not outweigh your rights and freedoms. Finagraph endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Finagraph and the practices described in this Privacy Policy. Finagraph also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate. Since it was founded, Finagraph has received zero government requests for information.

DATA SUBJECT RIGHTS

The European Union’s General Data Protection Regulation (GDPR) and other countries’ privacy laws provide certain rights for data subjects. Data Subject rights under GDPR include the following:

  • The right of access to the data - You have the right to obtain confirmation as to whether personal data concerning you is being processed, and, where that is the case, access to that personal data. Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, Finagraph will provide you with a date when the information will be provided. If for some reason access is denied, Finagraph will provide an explanation as to why access has been denied.

  • The right of rectification - You have the right to request the rectification of any inaccurate or incomplete personal data concerning yourself.

  • The right to "be forgotten"/ right of erasure - This refers to your right to have your personal data deleted from our database, including from any third parties who may have access to that data. However, where there are legal requirements for Finagraph to store the data for a certain period of time, related to our business, which includes elements of your personal data, we will not be able to delete that data until after the statutory retention period.

  • The right to restrict the processing of your data - You have the right to ask Finagraph to restrict the processing of your personal data where you challenge the accuracy of the personal data we are storing; Finagraph no longer needs your personal data for the purposes of the processing, or you have objected to processing

  • The right to object to processing – You have the right to object to processing of your personal data.

  • The right to data portability - You have the right to receive the personal data concerning you, which you provided to Finagraph, in a structured, commonly used and machine-readable format

  • Rights related to automated decision-making including profiling[1] 

  • This are short explanations about the rights of the data subjects.

 

This Privacy Policy is intended to provide you with information about what personal data Finagraph collects about you and how it is used.

If you wish to confirm that Finagraph is processing your personal data, or to have access to the personal data Finagraph may have about you, please contact us.

You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside Finagraph might have received the data from Finagraph; what the source of the information was (if you didn’t provide it directly to Finagraph) and how long it will be stored. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, Finagraph will provide you with a date when the information will be provided. If for some reason access is denied, Finagraph will provide an explanation as to why access has been denied.

OUR OBLIGATIONS

Finagraph takes the responsibility of the management and security of your personal data extremely seriously. In accordance with the General Data Protection Regulation, Finagraph, acting as a data controller and data processor, follows the key principles of data protection. These require that personal data to be:

  1. Processed lawfully, fairly and in a transparent manner;

  2. Collected for specified and legitimate purposes and not further processed in a manner that is incompatible with those purposes;

  3. Adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

  4. Accurate and kept up to date. Every reasonable step will be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;

  5. Kept for no longer than is necessary for the purposes for which the personal data is processed;

  6. Processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

DATA STORAGE AND RETENTION

Your personal data is stored by Finagraph on the servers of the cloud-based database management services the Finagraph engages, located in the United States. The Finagraph retains Service data for the duration of the customer’s business relationship with the Finagraph and for a period of time thereafter, to analyze the data for Finagraph’s own operations, and for historical and archiving purposes associated with Finagraph’s services. Finagraph retains prospect data until such time as it no longer has business value and is purged from Finagraph’s systems. All personal data that Finagraph controls may be deleted upon verified request from Data Subjects or their authorized agents.
